What birth injuries can indicate a medical malpractice claim?

The birth of a child may well be one of the most anticipated and joyous moments in any parent’s life. Some people forget that labor is a real medical emergency and requires special care in order to ensure the health of mother and child. If everything does not go smoothly, and a child suffers a birth injury, it may be in the family’s best interest to find out what happened.

It is true that some birth injuries are unavoidable, or due to a previous condition. However, sometimes the way the baby is prepped for, or actually delivered, is completed in a way that causes unnecessary harm to the infant. These injuries can manifest as cerebral palsy, Erb’s palsy, shoulder dystocia and others. These injuries can severely affect the course of that child’s life by saddling them with debilitating medical conditions.

The rehabilitation and loss of opportunity cost a child can suffer after a birth injury can sometimes be represented by a monetary value. If a practitioner, nurse or hospital is connected to a birth injury they could be held responsible for the financial costs and loss of quality of life associated with birth injuries. The money received by a family for a child suffering from an injury that occurred at birth can greatly help the injured and their families to return to a somewhat normal life. If an award is not received, it could mean debt or financial ruin from necessary medical costs.

A family who has a child suspected of suffering a birth injury often face challenges. Some of these challenges can be overcome, and others, a family will struggle with for the rest of their lives. Every child deserves a chance. If you or a loved one has a child who has lost this chance due to a birth injury, consider what this could mean for the family in the long-term.
