Motorcycle accidents can be caused by defects

Previous posts here have discussed how serious motorcycle accidents can be. These accidents can be caused by a distracted driver who is not paying attention to the road or even a driver who, while attentive, may have just not seen a motorcyclist because he or she was not anticipating one to be in the area.

However, some motorcycle crashes in the Albuquerque area can also be caused by a problem with the motorcycle itself. For example, the designer or manufacturer of the motorcycle may not have made the product correctly or engineered it in such a way that it is dangerous for the rider or, for that matter, even those around the motorcycle.

In these sorts of cases, the maker of the motorcycle has a duty to recall it so it can be repaired or replaced. Unfortunately, sometimes a product recall does not happen until it is too late, that is, until after a motorcyclist has been hurt or killed.

In other cases, the motorcycle may have been put together safely at the outset, but a mechanic who serviced the motorcycle down the road may not have repaired the vehicle correctly and instead left it in a dangerous condition which the rider might not be aware of until after a serious accident.

When these sorts of circumstances happen, the motorcyclist or the family of the motorcyclist may have the legal option to pursue compensation from the responsible parties, including the motorcycle’s manufacturer or the mechanic who repaired the motorcycle. Getting compensation allows victims to pay for things like medical bills and other out-of-pocket expenses, as well as to recover lost wages and damages for things like pain and suffering.
