Motorcycle accidents and the duty to secure loads

More so than other drivers, motorcyclists have to be mindful of objects on the road, as even small items like rocks can cause serious motorcycle accidents.

Due to the size and design of motorcycles, even a small item on the road may require a motorcyclist either to make a potentially dangerous emergency swerve or stop or risk being thrown from their bikes after hitting the object. Either scenario can leave a motorcyclist dead or recovering from life-altering and permanent injuries, including brain damage or paralysis.

This is one reason why it is so important for all drivers, both commercial drivers who haul loads for a living and those who may just be transporting something in their own vehicles, to make sure that whatever it is they are hauling is going to stay securely in the vehicle. This means drivers need to use the necessary straps, warning flags and the like for the safety of those drivers around them an in their general vicinity.

The law of New Mexico requires that all drivers keep their loads secure in their vehicles. This rule applies without exception and includes even small items like cardboard or even paper. If drivers do not follow this rule, then a law enforcement officer can write a ticket to the person, and the driver may wind up paying a fine.

Moreover, if it happens that a person’s load slipped off of their vehicle and wound up causing a motorcycle crash, then the person with the load may be financially accountable for the motorcycle accident. The driver may have to cover items like lost wages, medical bills and other compensation, including non-economic damages like pain and suffering.
